The advisory from the India — Ministry of Electronics and Information Technology could lead to increased compliance costs for social media platforms operating in India, potentially affecting their profitability and stock performance. Stricter content moderation requirements may also impact user engagement and growth for these platforms.

Social media Technology

The India — Ministry of Electronics and Information Technology (MeitY) in India issued an advisory on December 29, 2025, warning social media platforms and other online intermediaries of legal consequences if they fail to act against obscene, vulgar, pornographic, paedophilic, and other forms of unlawful content. The India — Ministry of Electronics and Information Technology observed a lack of consistency and rigor in platforms' actions against such content. The advisory reminded intermediaries of their statutory obligations under Section 79 of the Information Technology Act, 2000, and the Information Technology Rules, 2021. Non-compliance could lead to prosecution under the Information Technology Act, 2000, the Bharatiya Nyaya Sanhita, 2023, and other criminal laws. Platforms are required to make reasonable efforts to ensure users do not host or share prohibited content and to expeditiously remove unlawful content upon receiving actual knowledge through court orders or government intimation.
