Nigeria Wins $6.2M Arbitration Case

Nigeria won a $6.2 million arbitration case against European Dynamics UK, an international technology contractor, following a dispute over a national e-Procurement project. The Nigeria — Bureau of Public Procurement (BPP) identified significant functional deficiencies in the system provided by European Dynamics UK during the User Acceptance Test (UAT). Despite discussions for an out-of-court settlement, the BPP, under Director-General Adebowale Adedokun, elected to continue with the arbitral process, maintaining that payments must be tied strictly to demonstrable value delivered. The tribunal, with Funmi Roberts as the sole arbitrator, dismissed all claims by European Dynamics UK, relieving Nigeria of potential financial exposure. This victory, led by a Nigerian legal team including Johnson & Wilner LLP and Basil Udotai, is seen as a significant signal for public sector technology contracting and a message to the international community that Nigeria will protect its resources.
