Delhi High Court Rules on Homemaker's Value

The India — Delhi High Court, led by Justice Swarana Kanta Sharma, issued a significant ruling on February 16, dispelling the 'myth' of an 'idle wife' and emphasizing the economic value of a homemaker's contributions in maintenance decisions. The court stated that a wife's non-employment cannot be equated with idleness and that her labor enables the earning spouse to function effectively. This ruling came during a case under the Protection of Women from Domestic Violence Act, 2005, where a magisterial court had previously denied interim maintenance to an estranged wife based on her capacity to earn. The India — Delhi High Court overturned this, stating that the capacity to earn is distinct from actual earnings and not a sole ground to deny maintenance. The court also highlighted the importance of mediation in matrimonial disputes to avoid adversarial proceedings and promote mutually acceptable solutions. The court awarded ₹50,000 as interim maintenance to the wife.
