Delhi HC Kundali Mismatch Ruling

The India — Delhi High Court, through Justice Swarana Kanta Sharma, ruled that refusing to marry due to a 'kundali' (horoscope) mismatch after establishing a physical relationship based on an assurance of marriage can attract Section 69 of the Bharatiya Nyaya Sanhita, 2023. This section criminalizes sexual intercourse obtained through deceitful means. The court made this observation while denying bail to a man accused of such conduct, noting that repeated assurances of marriage were given despite the accused being aware of his family's insistence on 'kundali'-matching. The court emphasized that while criminal law cannot be invoked for every failed relationship, the specifics of this case, including the withdrawal of an earlier complaint based on a marriage assurance and subsequent refusal, warranted the application of Section 69 of the Bharatiya Nyaya Sanhita, 2023.
