Birchtech announced the termination of all remaining Inter Partes Review (IPR) petitions against its core patents for SEA® mercury emissions removal technology. This marks the end of a seven-year patent enforcement strategy that began in 2019. The company has received approximately $37.0 million in license fees and settlements since 2020. A federal jury in the United States — United States District Court for the District of Delaware returned a unanimous verdict in March 2024 against CERT defendants, with the final judgment amount increased to $78.4 million in December 2025. Additional litigation against utility defendants in the United States — United States District Court for the Southern District of Iowa led to IPR petitions at the United States — Patent Trial and Appeal Board, all of which have now been dismissed or resolved. This resolution permanently bars further patent validity challenges against Birchtech's SEA® technology, allowing the company to focus on its expansion into the North American water treatment market.
