The India — Telangana Real Estate Regulatory Authority (UP RERA) issued fresh guidelines to facilitate refund of excess Goods and Services Tax (GST) collected from homebuyers. The authority directed all registered real estate promoters to strictly adhere to GST rates notified by the central government. In consultation with the State Tax Department, UP RERA outlined a mechanism for homebuyers to claim refunds directly from the GST department when projects are cancelled or agreements terminated after the statutory period for promoter-issued credit notes has expired. Refund claims must be filed within two years, and claims below Rs 1,000 are not admissible. Promoters are required to issue credit notes and refund GST where the statutory period is still available.
