The rule introduces regulatory uncertainty for MFS providers, potentially capping fees and reducing profitability. However, it may boost consumer confidence and adoption if charges become more affordable.
The Bangladesh — High Court Division, Supreme Court of Bangladesh of Bangladesh issued a rule on July 26, 2026, asking authorities to explain why excessive service charges by mobile financial service providers BKash, Nagad, and Rocket should not be declared illegal and unconstitutional. The court also asked why a separate Mobile Financial Service Act should not be enacted to regulate charges, ensure consumer protection, and make fees reasonable for low-income and unbanked users. The rule was issued following a public interest litigation petition filed by lawyer Obaidullah Al Mamun Shakib. Respondents include the Finance Secretary, Posts and Telecommunications Secretary, and Bangladesh — Bangladesh Bank governor, who must respond within four weeks.
