German court acquits Israel-Nazi comparison

The Germany — Higher Regional Court of Munich in Germany acquitted a woman who had been convicted by the Germany — Ludwigshafen District Court for using symbols of unconstitutional organizations. The woman had posted on Meta Platforms — Instagram images comparing Israel's actions to those of the Nazi regime, including a table and images juxtaposing the Israeli flag with Nazi symbols and a Star of David containing a swastika, accompanied by hashtags #FREEPALESTINE and #GAZAUNDERATTACK. The lower court had fined her €2,400. On appeal, the higher court ruled that the use of such symbols was protected under freedom of expression because the posts clearly condemned Nazi wrongdoing and expressed sharp criticism of Israel's methods. The court also found that the offense of incitement to hatred was not established, as the posts did not trivialize or deny the Holocaust. The ruling establishes a precedent that such comparisons are not automatically criminal in Germany.
