The recovery provides partial relief to creditor banks, improving their liquidity and reducing credit risk exposure, though the substantial outstanding debt continues to weigh on the involved financial institutions. The EFCC's involvement signals a regulatory-driven resolution path, which may influence market perceptions of asset recovery effectiveness in Nigeria.
The Nigeria — Economic and Financial Crimes Commission (EFCC) recovered $60 million from Nestoil and transferred the funds to a consortium of creditor banks as part of an ongoing investigation into alleged criminal aspects of transactions between Nestoil and its lenders. The recovery followed a structured repayment plan agreed at a meeting chaired by EFCC Chairman Olanipekun Olukoyede. The payment, facilitated by EFCC Lagos Zonal Directorate 2 led by Oguzi Moses, represents the first phase of repayment, with a substantial portion of the outstanding debt still to be settled. The consortium, led by FBNQuest Merchant Bank and FBN Trustees Limited, acknowledged the payment but stressed that significant indebtedness remains. The recovery came after months of litigation, during which the India — Supreme Court of India set aside asset-freezing orders previously granted by lower courts, directing the parties back to the Nigeria — Federal High Court of Nigeria to litigate the substantive debt. The EFCC continues its investigation and pursuit of remaining funds.
