The Nigeria — Nigerian Electricity Regulatory Commission (NERC) has issued an order transferring regulatory oversight of the intrastate electricity market in Akwa Ibom State to the Nigeria — Akwa Ibom State Electricity Regulatory Commission (AKSERC). This transfer, effective under the amended Constitution and the Electricity Act 2023, makes Akwa Ibom the 17th state to assume control of its electricity market. NERC directed Abuja Electricity Distribution Company to incorporate a subsidiary, PHEDC SubCo, within 60 days from August 18, 2026, to handle intrastate supply and distribution in Akwa Ibom. The subsidiary must obtain a license from AKSERC. All transfers are to be completed by February 17, 2027. NERC retains oversight of interstate and international electricity operations. The move is part of Nigeria's broader decentralization of electricity regulation, aimed at bringing regulation closer to consumers and enabling states to attract investment tailored to their needs.
